Amendment Instrument Commences today

The Minister for Energy and Emissions Reduction has made the National Greenhouse and Energy Reporting (Safeguard Mechanism) Rule (No. 2) 2019. The Amendment Instrument commences today. The Instrument makes two amendments to the Safeguard Rule:

  1. It extends the 2018-19 baseline application deadline by just under six months, from
    31 October 2019 to 15 April 2020 for facilities on a Multi-Year Monitoring Period that covers, at a minimum, the 2018-19 and 2019-20 years; and
  2. It allows facilities to use the transitional calculated baseline criteria a second time from the 2019-20 year to adopt newly-established Government-determined prescribed production variables.

The first amendment helps to ensure there is sufficient time to consult industry during the development of priority prescribed production variables and default emissions intensities, and to allow for the first tranche of priority default values to be available for use in the 2018-19 compliance year.

The second amendment removes barriers to adopting Government-determined prescribed production variables and default emissions intensity values where facilities apply for a calculated baseline ahead of the Government-determined defaults being made available. This will help to ensure facilities have access to baselines that adjust annually with production.
